Trends in the Landowners retention rights over agricultural land

The Department of Agrarian Reform (DAR) is the Philippine key agency tasked for equitable distribution and ownership of land as mandated by Republic Act 6657 otherwise known as Comprehensive Agrarian Reform Law of 1998. The DAR-Agusan del Norte took active participation effecting such mandate. Under Sec. 6 of RA 6657, the landowner has the right to retain the maximum limit of five (5) hectares. however, it has been observed that some landowners were not able ot retain the (5) retention limit. Based on the above observation, a study was conducted to appraise the trend on application for retention to identify the lapses and problems of the process. The findings point out that the trend on the issuance of certificates for retention were affected by some factors like compliance of approved subdivision plans indicating the (5) hectares which is compact or contiguous parcel of land which is one of the basic requirements. There should be a re-orientation or seminar briefing on the process of landowner's application of retention.
