Republic Act 9262 and the women victims of violence in Davao City

Abstract / Excerpt:

ABSTRACT: This study reflects the experiences of women victims of domestic violence in Davao city before, during and after availment of the provisions of Republic Act 9262 or the Anti-Violence Against Women and their Children Act of 2004 (AVAWCA 2004). The inhibiting and facilitating factors shared by the women victims in their availment of RA 9262 along with their expressed experiences with the various pillars of the justice system show the discrepancies between the intent and spirit of the law, and the actual applications, or compliance with RA 9262. The culture of patriarchy is still pervasive in the administration of justice according to the victims of violence. Gender insensitivity is pronounced in the handling of their cases thus they are unable to fully enjoy their rights and entitlements under the present system.
