A case study on the prosecution of sexual abuse cases

Abstract / Excerpt:

This paper focuses on the profile of sexual abuse cases in the courts of justice in terms of the nature or type, victims, perpetrators and status. It also focuses on the experience of the sexually abused children before the filing of the cases and during the prosecution of the cases, the factors that facilitate the dismissal of the cases and hinder the effective prosecution of the cases and the convection of the accused. The research design used is descriptive, using qualitative approach. The study is conducted in Balay Dangupan in Davao City. Based on the data gathered, the significant findings are that majority of the nature of cases filed before the courts and assisted by Balay Dangupan are rape cases. The perpetrators are relatives of the minor victims by consanguinity, live-in partner of the victim's mother, father of the victim's common-law husband or neighbor of the victim. All of the cases of the ten respondents are pending in the Regional Trial Court in Davao City designated as the Family Court. Based on the cases of the ten respondents, the living condition condition of the victim with the penetrator can be a factor for the repeated commission of the offense by the penetrator against the same victim. The experiences of Sexually Abused Children before the filing of the case and during the prosecution of the case may lead to the dismissal of the case. Also, based on the data gathered, the factors that facilitate the dismissal of cases are lack of support from the mother or the family of the victim and the long period involved in the prosecution and disposition of the cases. The recommendation to address the problems are to provide for additional care institution, for the legislature to provide for laws to protect the care institutions from baseless suits and to provide for additional family courts.
