Is EO 79 an issuance that can withstand the initial legal scrutiny. Is it an allowable exercise of the Chief Executive powers? The answer appears to be in the affirmative. The President authority to issue executive orders is denied and limited by Book III, Title I, Chapter 2, Sec. 2 of the Administrative Code. The Court interpreted this to mean that executive orders would only be proper if they are issued to give effect to laws, not in their absence, much less against them.

Is EO 79 an issuance that can withstand the initial legal scrutiny. Is it an allowable exercise of the Chief Executive powers? The answer appears to be in the affirmative. The President authority to issue executive orders is denied and limited by Book III, Title I, Chapter 2, Sec. 2 of the Administrative Code.
